Fr. Stansamy's death is a negligent murder in judicial custody | CDRO


Fr. StanSamy's  death is nothing but a blatant murder in judicial custody. Mode  Government and the Judiciary both are equally responsible for his death. His death is an example for the fascist face Indian state in the hands of Modi and Amith Sha.  It is sham to the Indian state to keep an old man aged 84 years in jail. Not only the democracy, but also Indian Judiciary is   on ventilator. It is a dark day in the history of the Indian Judiciary, which failed to consider a plea of an old person, who has been suffering with parkinson’s  disease, by  considering his post Covid Complications.  

 

Co-ordination of Democratic Rights Organisations (CDRO) strongly condemns the death of Fr.Stan Swamy. It is high time to the Indian judiciary to retrospect itself about its role in protecting the victims of State Violence. On one hand the state enacted draconian laws like UAPA, in the name of  security   of the nation, on the other hand the courts are nodding its heads. Courts went for away from the principle of “Bail is rule, jail is exception”. Supreme court ruling on bail in UAPA cases  is highly undemocratic. 

 

Fr. Stan Swamy sought interim bail in the month may, on grounds of various health issues. He was appeared before Bombay hight Court through Vedio-conference from Taloja Jail and told the court that when he was brought to the jail, his core system were working properly, but there had been deterioration of his health condition  and he was unable to perform daily Chores, including eating and walking without assistance. When the judges asked him to join in Government hospital, he reiterated that “ I would prefer to die in jail, rather than to join in the hospital”. Finally requested the court to grant interim bail on medical grounds.  For judiciary, the life of an old man is not that much impartment, hence it  has been post phoning the hearings on various reasons for all these days. When finally, when the court set the time today by 2.30 pm for hearing. But, by 1.30 pm Doctors of Holy Family Hospital, declared him dead.    

 

Attempts to get the Bhima Koregaon under trials released on medical grounds as jail premises don't have facilities to cater to the medical needs, were scuttled by red tapism by jail authorities.

 

Now the misfortune has fallen upon us in Stan's death,  the authorities should forthwith release all the Bhima koregaon under trials on bail immediately as Bail is a rule and Jail shall be an exception as per judicious approach.

 

Raise in chorus for release on bail for bhima koregaon under trailers, and other political prisoners.


We demand immediate repeal of UAPA and NIA. We further demand to drop any further action in this case.
